Kershaw County Parks and Recreation Department (KCPRD) Facility Use Agreement

*Application subject to the terms and conditions of this Agreement.

*User acknowledges that the Director of KCPRD reserves the right to accept, reject or modify an event based on the impact or the overall benefit to the community.

*User understands that damage to KCPRD facilities or property and/or failure to abide by the terms of this Agreement constitute grounds for cancellation of this Agreement and forfeiture of any fees and/or deposits tendered to KCPRD and may impact future applications to use KCPRD facilities. KCPRD and local law enforcement reserve the right to enter the premises at any time to observe User activities and, if necessary, to terminate the event and/or activities immediately without refund.

*In the event KCPRD incurs any charge due to the activities of User, User shall reimburse KCPRD for the full amount of the charge immediately upon the date of written notice to User of the amount of the charge.

*KCPRD assumes no responsibility for interruption of any services for any reason whatsoever.

*Stoves/ovens may only be used to re-heat and/or warm food.

*Unless otherwise approved by the Director of KCPRD, the User and its participants shall be prohibited from using tobacco products, consuming alcoholic beverages and/or using illegal drugs, intoxicants or other controlled substances and from bringing weapons to the Space. The term "weapons" includes, but is not limited to, firearms, ammunition, knives or explosive devices.

*Children under eighteen (18) years of age must be chaperoned and chaperones may not leave until all children have secured rides home.

*KCPRD may require the User to provide proof of liability insurance and name KCPRD as an additional insured.

*User shall not transfer or assign any interest in this Agreement without prior written authorization by the Director of KCPRD.

*Inflatables are not permitted

It is expressly understood and agreed that the applicant assumes all risk for loss, damage, liability, costs or expense that may arise during or be caused in any way by use or occupancy of the facilities of KCPRD. In consideration for being permitted to use the KCPRD facility in its "as is" condition, the applicant further agrees to save and hold harmless KCPRD, its officers, agents, employees, volunteers from any loss, claims and/or liability damages and/or injuries to persons and/or property resulting from applicant's use of KCPRD facilities. I, the undersigned, hereby certify to abide by the regulations governing the above facility and agree to abide by all state
and federal laws, Kershaw County ordinances, rules and/or policies, and that I am the representative of the user's organization. I further agree to be personally responsible for any damages or losses sustained on the grounds, buildings, furniture and/or equipment or unusual cleanup through the occupancy of the facility. Unless the applicant rents the entire facility, KCPRD reserves the right to lease or use for its own purposes other spaces at the facility.
